These Terms of Service ("Terms") govern your use of the SpeakCast live interpretation service ("Service") operated by SpeakCast ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
SpeakCast provides real-time speech translation via web browser. A paying subscriber ("Speaker") may create a live session. Other users ("Listeners") may join sessions without payment or registration. Translation is powered by third-party APIs and browser-based speech recognition technology.
To use the Speaker role, you must create an account and maintain an active paid subscription at $5.00 USD per month. You agree to provide accurate registration information. You are responsible for maintaining the confidentiality of your account credentials. You may not share your account with others.
Subscriptions are billed monthly. You may cancel at any time through your Account page. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial months or unused sessions.

The Service uses automated machine translation, which is inherently imperfect. We make no representations or warranties regarding the accuracy, completeness, or suitability of any translation produced by the Service. You are solely responsible for verifying important communications. Do not rely on SpeakCast for medical, legal, safety-critical, or emergency communications.
The Service and its original content, features, and functionality are and will remain the exclusive property of SpeakCast. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission. Content you transmit through the Service remains your property; you grant us a limited license to process and transmit it solely to provide the Service.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by this reference.
The Service integrates with third-party services including Stripe (payment processing), Google Web Speech API (speech recognition), and MyMemory (translation). Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices of any third-party service providers.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SPEAKCAST BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE SIX (6) MONTHS PRECEDING THE CLAIM.
You agree to defend, indemnify, and hold harmless SpeakCast and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.
We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or for any other reason. Upon termination, your right to use the Service will immediately cease.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved by binding arbitration in accordance with the American Arbitration Association's rules.
We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last updated" date at the top of this page. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.
