This End User License Agreement ("EULA") is a legal agreement between you ("User," "you," or "your") and SpeakCast ("Licensor," "we," "us," or "our") regarding your use of the SpeakCast web-based live interpretation service, including all associated software, interfaces, features, and content (collectively, the "Software").
By clicking "Create Account," subscribing to the Service, or otherwise accessing the Software, you acknowledge that you have read, understood, and agree to be bound by the terms of this EULA. If you do not agree, do not use the Software.
Subject to your compliance with this EULA and payment of any applicable fees, Licensor grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Software solely for your personal or organizational non-commercial communication purposes, as a browser-based web service. This license does not include the right to sublicense, sell, resell, transfer, assign, or otherwise commercially exploit the Software.

The Speaker role requires a paid subscription of $5.00 USD per month, billed via Stripe. The Listener role is free and requires no account. Fees are non-refundable except as required by law. Licensor reserves the right to change pricing with 30 days' notice to active subscribers.
The Software, including all code, design, trademarks, trade names, and other intellectual property, is and shall remain the exclusive property of Licensor. This EULA does not grant you any rights to Licensor's trademarks or service marks. You retain ownership of all content you transmit through the Software; you grant Licensor a limited, royalty-free license to process and transmit such content solely to provide the Service.
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. LICENSOR EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. LICENSOR DOES NOT WARRANT THAT THE SOFTWARE WILL MEET YOUR REQUIREMENTS, OPERATE WITHOUT INTERRUPTION, OR BE ERROR-FREE. TRANSLATION OUTPUT IS MACHINE-GENERATED AND MAY CONTAIN ERRORS. YOU ASSUME ALL RISK ASSOCIATED WITH USE OF THE SOFTWARE.
TO THE FULLEST EXTENT PERMITTED BY LAW, LICENSOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH THIS EULA OR YOUR USE OF THE SOFTWARE, EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. LICENSOR'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS UNDER THIS EULA SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO LICENSOR IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
The Software uses automated machine translation technology. Licensor makes no representation or warranty as to the accuracy, reliability, or completeness of any translation. You expressly acknowledge that translations may contain errors, omissions, or mistranslations. The Software is not suitable for medical, legal, safety-critical, governmental, or emergency use. You assume all responsibility for verifying any translated content before acting on it.
Licensor reserves the right to modify, update, suspend, or discontinue the Software or any part thereof at any time with or without notice. Licensor will not be liable to you or any third party for any modification, suspension, or discontinuance of the Software. Updates may be applied automatically without notice.
This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must immediately cease all use of the Software. Sections 4, 5, 6, 7, 10, and 11 shall survive termination.
This EULA shall be governed by the laws of the United States. Any dispute arising from or relating to this EULA shall be resolved by binding individual arbitration, not class action. You waive your right to participate in a class action lawsuit or class-wide arbitration. The arbitration shall be conducted by the American Arbitration Association under its Commercial Arbitration Rules.
This EULA, together with our Terms of Service and Privacy Policy, constitutes the entire agreement between you and Licensor with respect to the Software and supersedes all prior or contemporaneous understandings, agreements, representations, and warranties.
If any provision of this EULA is found to be unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.
